This is my reply to the Florida ECC and SOS reply to my appeal brief in the First District Court of Appeals. Obama did not reply, but the ECC and SOS say that he believes the "contest window" (section 2 of 3 US Code 5) has already passed. More on that in a minute. This is the Appeal of the second case (2012 CA 3489), filed after the General Election, where Judge Carroll cited "Miracle on 47th St." The defendants are claiming that 1) It is a political question. 2) that Obama was not "elected", his electors were. 3) that I failed to "ask" for a hearing.

In this reply I thoroughly defeat any thought that this is a "political question" (one reserved to the Constitutional function of a political body--- Congress). NOWHERE in the Constitution does it say anything about Congress vetting a Presidential candidate, and they are SPECIFICALLY barred from deciding who should be President. The ECC's own certificate of Election PLAINLY states that "Barack H. Obama was elected President of the United States". As for Obama, his lack of response subjects him to Fl. SS. 102.168(6):

"(6)  A copy of the complaint shall be served upon the defendant and any other person named therein in the same manner as in other civil cases under the laws of this state. Within 10 days after the complaint has been served, the defendant must file an answer admitting or denying the allegations on which the contestant relies or stating that the defendant has no knowledge or information concerning the allegations, which shall be deemed a denial of the allegations, and must state any other defenses, in law or fact, on which the defendant relies. If an answer is not filed within the time prescribed, the defendant may not be granted a hearing in court to assert any claim or objection that is required by this subsection to be stated in an answer".

Before he replies in the future, he will now have to ask the court if he can reply. Of course he thinks he is above all of this "eligibility" talk.

The fact that the court failed to rule on my case before the section 2 window closed on December 11, 2012 (6 days before the meeting of electors) cannot create the defense that the window expired (see the citation of Osborne v. Newly released video of police interview with Zimmerman's girlfriend suggests that despite her recantation she was telling the truth about his threats.

After a domestic dispute and call to 911 in November, George Zimmerman's girlfriend told police officers that he had threatened her with a shotgun. The allegations echoed those of Zimmerman's ex-wife following his acquittal on charges of murdering unarmed teenager Trayvon Martin, and seemed to signal a pattern of uncontrolled violence.

"I feel like he always gets off," pregnant 27-year-old Samantha Scheibe told a police investigator after her boyfriend, George Zimmerman, pointed a shotgun at her and smashed her belongings. Scheibe was right, again.

Scheibe later recanted, saying in a sworn statement that she was "intimidated" during police questioning and believed investigators had "misinterpreted" her words.

A recently released video of Scheibe's police interview leaked online by ZimmermanVerdict.net, not only casts doubt on her disavowal, it also adds credibility and disturbing violent new details to Scheibe's original account.

Okay I listened to the entire video and if she was lying, or exaggerating, she sure fooled me.

So if she was telling the truth to the police, what made her take it all back later?

And what in the hell would convince her to go back to him?

This comparison comes from the Guttmacher Institute, which finds that states passed 205 abortion restrictions between 2011 and 2013, more than the 189 laws passed between 2001 and 2010. Nearly half of the laws - 45 percent - fell into three categories: targeted regulations of abortion providers, bans on abortions after 20 weeks and restrictions on medical abortions. "States enacted 93 measures in these four categories from 2011 through 2013, compared with 22 during the previous decade," the Guttmacher analysis finds.

What made 2010 such a boom year for abortion restrictions? It's hard to pinpoint a particular reason, but a few factors do stand out. First, Republicans took control of lots of state legislatures in the 2010 midterm elections, allowing them to pass more restrictions than was politically feasible in the past. The Affordable Care Act also ignited a fight over abortion policy, particularly whether federal funds would help pay for abortions (when Americans used their tax subsidies to purchase health insurance coverage). That fight spilled over to state legislatures - the ones that Republicans had recently come to control - and many passed laws restricting insurance coverage of abortion.

But remember, there is NO War on Women.

This is the kind of thing that should be driving women to the polls by the millions in 2014. And hopefully it will.

New years are known for new resolutions, but in one North Texas town, the mayor has proclaimed 2014 the Year of the Bible.

It's a declaration--or an official announcement. Mayors do it all the time for whatever they reason they choose to. In the case of Flower Mound, the mayor wanted his community to connect through the Bible.

"I was nervous about doing this," said Mayor Tom Hayden. "And I've been thinking about it for two years, and procrastinated about if for as long as I possibly could."

The proclamation was made by Hayden during a city council meeting last month.

The Year of the Bible has two parts: the genesis of Hayden's proclamation borrows heavily from former President Reagan's almost identical proclamation in 1983, and quotes various presidents while pointing out America's founding documents are Biblically-based.

The second part is a Bible-based website: thebible2014.com.

"The way it's set up is that people would have the same scripture each day," said Jon Bell of Calvary Chapel. "That they would go over and so that at the end of the year, they'd have gone through the whole Bible in a year."

The mayor says the proclamation was not law, not voted on by the Flower Mound City Council and not an official town action.

However, it still raises some questions with some Flower Mound residents.

"He was elected mayor," said Flower Mound resident Curt Orton. "Not as the spiritual leader of Flower Mound."

Apparently this idiot thinks its 1714 instead of 2014.

Gee it must be very nice for the Hindus, Buddhists, and non-religious to have a website sponsored, paid for, and maintained by the city to go to and read from a book that they do not believe in.

A Utah man vows to go without food until the state stops issuing marriage licenses to same-sex couples.

Trestin Meacham believes the state has the ability to “nullify” the recent decision allowing same-sex couples the right to marry. States, he believes, have the right to “nullify any unconstitutional action of the Federal Government,” and that this decision is “patently unconstitutional.”

By his reckoning, states have unilateral authority to reject any decision made by the federal government, and cites as evidence a series of failed attempts to have this belief recognized in courts of law.

Meacham remains undeterred. In a post on his public Facebook page flush with false humility, he writes that “I cannot stand by and do nothing while this evil takes root in my home. Some things in life are worth sacrificing one’s heath and even life if necessary. I am but a man, and do not have the money and power to make any noticeable influence in our corrupt system. Never the less, I can do something that people in power cannot ignore.”

He claims that his opposition to same-sex marriage “has nothing to do with hatred of a group of people,” but on his blog, he is quick to note that the challenge to Judge Shelby’s decision will be “will be heard by Sonia Sotomayor, a known champion of the homosexual movement.”

On the down side if this guy thinks that skipping a few meals is going to convince gays to stop fighting for the right to marry he is fasting up the wrong tree.

On the other hand he has already lost 25 pounds and he looks Faaaabuloooous!

Police say a 33-year-old Tahlequah man wielding a hammer and a Bible had to be electrocuted with a taser four times Saturday when he held another man in a headlock and claimed he was “doing the Lord’s work.”

Mitchell D. Hummingbird was being held Monday at the Cherokee County Detention Center with a $35,000 bond. Hummingbird could face charges of assault and battery with a deadly weapon, assault and battery on an officer, resisting, and public intoxication.

Deputy Michael Cates was asked to investigate an altercation between Hummingbird and another man at Butterfly Trailer Park Saturday. Hummingbird came to the door when Cates arrived and allegedly had a hammer and Bible in his left hand. Another man in the home tried to get away from Hummingbird when the door opened, but Hummingbird had the man by his shirt collar.

Cates said he grabbed Hummingbird and pulled him outside of the home, but Hummingbird refused to drop his hammer. Cates eventually drew his firearm and held Hummingbird at gunpoint.

According to Cates, the deputy asked Hummingbird to drop the hammer, but Hummingbird refused and continued holding onto the victim by the neck, saying he was “doing the Lord’s work.” Cates called for assistance from Tahlequah police and the Cherokee Nation Marshal Service. Deputy Josh Girdner soon arrived to help Cates, as did Cherokee Nation Deputy Marshal Bronson McNiel.

McNiel, who carries a taser, ordered Hummingbird to drop his hammer, but Hummingbird allegedly continued to defy officers’ commands and began to wave the hammer around. McNiel deployed his taser on Hummingbird, but the first shot had no effect on the man, who allegedly asked officers if the taser was “supposed to hurt.” McNiel again shot Hummingbird with the taser. The second jolt seemed to affect Hummingbird, but he was able to keep his balance.

According to Cates, Deputy Josh Girdner attempted to take Hummingbird to the ground, but Hummingbird swung his hammer and struck the deputy on the hand while keeping his victim in a headlock. The deputy was eventually able to take Hummingbird down, and the three officers began to battle to get him into custody.

I love this last part here:

Deputies said Hummingbird apparently felt he was trying to “save” the victim. He was also under the influence of some substance, and had to seek treatment before he could be booked into jail.

Yeah it's called being under the influence of the holy spirit, heathens!

"Though I walk through the valley of death, I shall fear no taser, for you are with lord, and the electricity shall comfort me. That and the PCP I am currently on."

Seriously what kind of a country is this where a man cannot do the Lord's work by pummeling a fellow man about the head and shoulders with the Good Book and a Craftsman hammer?

Conservative activists opposed to President Barack Obama's healthcare overhaul started a new assault on the Affordable Care Act as more than 2 million people began new health coverage under the law on Thursday.

One group, which is backed by the libertarian billionaire brothers Charles and David Koch, launched a $2.5 million television ad campaign that targets three Democratic senators who support the law and could face stiff challenges from Republicans in November elections.

The group, Americans for Prosperity, or AFP, spent more than $36 million on the 2012 elections, largely for ads that bashed the law known as Obamacare and Democrats who supported it.

The ads by AFP are aimed at North Carolina's Kay Hagan, Louisiana's Mary Landrieu and New Hampshire's Jeanne Shaheen. Their bids for re-election will be crucial to Democrats' efforts to keep control of the U.S. Senate, where Democrats control 55 of the 100 seats.

The 30-second videos represent something of a turn in strategy for conservatives, who have spent much of the past year focused on calling for the repeal of the healthcare law, the most sweeping social program since the 1960s.

Now, with more than 2 million people having signed up for Obamacare and more enrolling for coverage every day, AFP and other critics are signaling that in advance of the elections, they will try to cast Democrats as liars who misled Americans about the law.

The new ads try to link the senators to Obama and his discredited pledge that all Americans who liked their healthcare plans before Obamacare went into effect could keep those plans.

That of course relies on belief in the GOP talking point that says 5 million people will lose their current health care plans under Obamacare.

However if California Democratic Senator Henry Waxman has his way that talking point is about to crash head on into a giant factual wall.

To that end, Rep. Henry Waxman (D-Calif.) and Dems on the House Energy and Commerce Committee published a report (pdf) this week intended to bring the debate into sharper focus. As George Zornick reported, Waxman found that even if we use the Republicans’ figure as a dubious baseline, the specific outcomes leave the GOP argument in tatters.

* According to the report, half of the 4.7 million will have the option to renew their 2013 plans, thanks to an administrative fix this year.

* Of the remaining 2.35 million individuals, 1.4 million should be eligible for tax credits through the marketplaces or Medicaid, according to the report.

* Of the remaining 950,000 individuals, fewer than 10,000 people in 18 counties will lack access to an affordable catastrophic plan.

In other words, even giving Republicans the benefit of the doubt, we’re looking at 10,000 Americans on the individual market who (a) can’t keep their existing plan; (b) can’t enroll in Medicaid; (c) can’t get subsidized coverage through an exchange; and (d) can’t get catastrophic coverage.

Or put another way, when Republicans talk about the 5 million people left behind by the ACA, they’re exaggerating by a factor of 500.

Now much like the GOP response to the New York Times article blowing the Benghazi conspiracy out of the water, you can expect a whole lot of cognitive dissonance and misrepresentation of the facts. But that should only energize those of us on the Left to make it our duty to make sure that the truth gets out their far and wide to help undermine efforts to defeat progressives using this mischaracterization of the facts.
